Documentation needed to register

Each business is required to fill out an application form and bring the following documentation.

New Business:
A new business is required to fill out the application form available in English, Pashto and Dari languages along with these basic documents.

  • An official letter from the relevant licensing office that will later be responsible for issuing a license to the new business
  • Copy of Tazkera or Passport of the president and vice president of the business.
  • 2 sets of color passport photographs of the president and vice president of the business.
  • Article of Incorporation.  This document is drafted by a corporation or partnership.  It must list the names of owners, shares, and other agreement clauses. This document is submitted only once to ACBR.  If there is a change in this document the business must report the changes to ACBR and submit the most recent document.
  • A copy of the business license once issued by the relevant license department.

 

Change in Business:
If a business is already registered in ACBR but they made changes regarding its ownership or other related data previously registered with ACBR, the business must re-register to maintain its legal position according to the Law. The documents involved in modifying a business are:


If already registered with ACBR:

  • Copy of Tazkera or passport of the new president and vice president of the business.
  • 2 sets of color passport photographs of the new president and vice president of the business.
  • The new Article of incorporation (if any changes have been made)
  • Letter from the Revenue Department of Ministry of Finance located in the Pamir building in Kabul and in Mustofiat building in Jalalabad. This letter is needed only if there is a change in percentage of shares of the President or Vice President.
  • Latest TIN certificate only if name of the company changes. 
  • Copy of business license.
  • In case of change of address none of above mentioned documents is needed.
  • Change of any specification will require paying standard ACBR fees.


If a business is not already registered in ACBR, then all above mentioned supporting documentation for new is needed.

Close a Business

If a business is no longer operational, the business needs to be closed officially with ACBR and the relevant licensing entity.  The close of the business also needs to be reported to the Revenue Office of Ministry of Finance.

If a business is already registered with ACBR:

  • Business should inform relevant licensing entity first.
  • Picture identification (Tazkera or passport of the president and vice president of the business).
  • Letter from the Revenue Department confirming taxes are paid.
  • Proof of TIN certificate deactivated from TIN office of the MoF.
  • Letter declaring dissolution of business from the business with executive management signatures and the official stamp of the business.
  •        
    For businesses previously registered with the Commercial Court but not ACBR:

  • Business should inform relevant licensing entity first.
  • Copy of Tazkera or passport of the president and vice president of the business.
  • 2 sets of color passport photographs of the President and Vice President of the business.
  • Letter from the Revenue Department confirming taxes are paid.
  • Proof of TIN certificate deactivated from TIN office of the MoF.
  • Letter declaring dissolution of business from the business with executive management signatures and the official stamp of the business.
  • Article of incorporation (required if business is incorporated).
